Terms and Conditions of Sale

Before placing any order, the customer acknowledges having read these terms.

2. Purpose

These Terms and Conditions of Sale (T&Cs) define the rights and obligations of the parties regarding the sale of wine bottles by Ysabeau (hereafter referred to as "the Seller") to consumers or professionals (hereafter referred to as "the Customer") in Belgium.

 

3. Protection of Minors

• In accordance with Belgian legislation, the sale of alcoholic beverages is prohibited to minors under 18 years of age.

• By placing an order, the customer declares they are at least 18 years old.

 

4. Prices

• Product prices are listed in euros (€), inclusive of all taxes (including VAT), unless stated otherwise.

• The Seller reserves the right to modify prices at any time. However, the price invoiced will be the one in effect at the time of the order’s validation by the Customer.

• Delivery charges are the responsibility of the Customer and are mentioned before the final validation of the order.

 

5. Orders

• The Customer must provide complete contact information when placing an order, including billing address, delivery address, VAT number, phone number, email address, and contact person.

• Validation of the order by the Customer constitutes acceptance of these T&Cs.

• The Seller reserves the right to refuse or cancel an order if it is deemed abnormal, fraudulent, or for any other legitimate reason.

 

6. Payment Terms

• Payment is required upon ordering (payable immediately). No delivery will be made until full payment of the order has been received.

• The Seller retains full and exclusive ownership of the goods until full payment is made.

 

7. Delivery

• Deliveries are made to the address provided by the Customer at the time of ordering.

• Delivery times are indicative and may vary depending on the delivery location and product availability.

• In the event of significant delays or force majeure, the Seller cannot be held liable. However, the Customer will be informed of any foreseeable delays.

• Signing the delivery receipt constitutes acceptance of the delivery by the Customer.

• If a delivery arrives damaged, the Customer must refuse it in whole or in part, no later than the time of signing the delivery note.

• The courier will notify Ysabeau SRL, which will promptly arrange for a replacement shipment.

 

8. Returns

• In accordance with Belgian and European legislation, the Customer has a 14-calendar-day right of withdrawal from receipt of the products, without needing to provide a reason or pay penalties.

• The Customer must notify the Seller of their decision to withdraw in writing (letter or email) before this period expires.

• Returned products must be in perfect condition and in their original packaging (return shipping is at the Customer’s risk). Return costs are borne by the Customer.

• Refunds will be processed within 14 days of receiving the returned products.

9. Disputes and Governing Law

These T&Cs are governed by Belgian law.

In the event of a dispute, an amicable resolution will be sought before any legal action. Failing agreement, the courts in the judicial district of Marche-en-Famenne will have exclusive jurisdiction.

 

10. Amendments to T&Cs

The Seller reserves the right to amend these T&Cs at any time. The new T&Cs will apply to orders placed after their publication.
